Terms of Service
1 | Acceptance of Terms
By accessing or using the PT Organizer application (“the App”), which is operated by PayPTPro LLC under license from Osirix FZE, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.
Osirix FZE remains the trademark owner of PT Organizer and has access to the systems and databases for support and development purposes. However, all user data is managed by PayPTPro LLC and will not be migrated outside of the established systems without explicit notification to users.
2 | Definitions
• “PT”: Personal Trainer
• “Client”: An individual receiving personal training services
• “Session”: A scheduled training appointment between a PT and Client
• “Content”: All information, text, images, and data uploaded to or generated within the App
• “Trial Session”: A free initial training session between an unmatched PT and potential client
3 | User Accounts
3.1 Account Types
The App provides two types of user accounts:
• Personal Trainer (PT) accounts
• Client accounts
3.2 Trial Sessions
• No personal data is collected during trial sessions until client matching occurs
• Matching after trial sessions is optional
• Trial sessions cannot be scheduled in advance
• Trial sessions must be completed immediately after QR code scanning
• Trial session data is deleted when PT indicates no match is expected
• Trial sessions can only be conducted through the mobile app
3.3 Account Requirements
• Users must provide accurate and complete information
• Users are responsible for maintaining account security
• Users must be at least 18 years old
• One account per user is permitted
• Only one device can be logged in at a time
• User data is stored on secure servers and restored upon login to new device or app reinstallation
• Account access cannot be delegated to third parties
4 | Payment Terms
4.1 Payment Processing
• All payments and refunds are processed by Stripe and bound by their terms
• PT Organizer does not see or hold any payment data
• All payment data is held and processed securely by Stripe
• Stripe monitors for fraud and irregular card usage
• Failed payments:
o Do not add any new sessions for booking
o Do not affect existing booked sessions
o Further payment attempts are subject to Stripe’s fraud detection policies
4.2 Service Fees
The following fees apply to all transactions:
• Stripe Processing Fee: 2.9% + $0.30 per transaction
• Stripe Connect Fee: 0.5%
• PT Organizer Platform Fee: 1.49%
4.3 Session Expiration
• There are no in-built expiry dates but these are at PTs discretion
• PT and client must agree verbally if any expiry will occur
• The app will not automatically expire sessions; the PT will need to forfeit them manually if they expire
• Any expiration policy set by a PT must be clearly communicated to the client prior to purchase
5 | Session Management
5.1 Scheduling
• PT Organizer is a mobile-only application
• Sessions must be scheduled through the mobile App
• Schedule changes require mutual agreement; clients can request changes through the app and PTs can accept or propose alternative times, and clients can subsequently propose further changes to times suggested by the PT
• No limits on number of reschedules or cancellations
• Cancellation policies are set by individual PTs
• PTs and clients are expected to train face-to-face
• When PT enables calendar visibility:
o Clients can view available time slots within PT’s working hours
o Clients can only request sessions during PT’s specified working days
o Blocked time slots are not visible to clients
5.2 Session Types
5.2.1 Regular Sessions
• Must be scheduled in advance
• Require payment before confirmation
• Can be rescheduled or cancelled per PT policy
5.2.2 Trial Sessions
• Cannot be scheduled in advance
• Must be completed immediately
• No payment required
6 | Content and Data
6.1 User Content
All data collected through the Services, including but not limited to:
• Workout data
• User information
• Usage statistics
• Photos and measurements
Is owned by PayPTPro LLC and is securely held on encrypted databases. All data is stored and processed on AWS servers located in the United States. By using the App, you consent to the storage of your information on AWS servers in the United States.
6.2 Data Usage
• Data collection and use governed by Privacy Policy
• User data protected per applicable privacy laws
• Exercise and progress data shared between matched PT-Client pairs
• After unmatching:
o Clients retain access to their historical workout data
o PTs can only see former client in their list without access to workout data
• Progress photos and measurements are not used for marketing purposes
• Workout ratings are mandatory and will be used to help potential clients find and evaluate PTs
• Workout ratings are mandatory after each session:
o Individual ratings remain private to the client
o PTs can only see their overall average rating
o Ratings are not publicly displayed
• All user data is retained indefinitely after account deactivation
• Users can request permanent deletion of their data by emailing support@pt-organizer.com
7 | Progress Photo Feature
7.1 Purpose and Scope
The Progress Photo feature (“Photo Feature”) is provided solely for the purpose of tracking physical fitness progress within a professional training relationship. By using the Photo Feature, you acknowledge and agree that it shall be used exclusively for documenting legitimate fitness-related progress.
7.2 User Responsibilities
Users who upload, store, or view photos through the Photo Feature agree to the following:
a. Appropriate Content: All photos must be appropriate for a professional fitness context and contain only subjects wearing suitable athletic/fitness attire.
b. Consent: Photos of any individual must be taken and uploaded with their explicit consent. You represent and warrant that you have obtained all necessary permissions before uploading any photo containing any person.
c. Compliance: Users shall comply with all applicable laws and regulations regarding the creation, storage, and viewing of photographic content.
d. Prohibited Content: Users shall not upload, store, or view photos that contain any of the following:
Sexually explicit or suggestive content
Nudity or partial nudity not appropriate in a fitness context
Content involving minors
Violent or graphic content
Harassing, discriminatory, or hateful content
Any content that violates applicable laws or regulations
Any content not directly related to fitness progress tracking
7.3 Content Moderation
PT Organizer employs automated and, when necessary, manual content moderation systems to enforce these terms.
a. Automated Screening: All uploaded photos are automatically screened for prohibited content. Photos flagged by our systems may be rejected automatically.
b. Manual Review: In certain cases, flagged content may undergo manual review by authorized PT Organizer personnel.
c. Removal Rights: PT Organizer reserves the right to remove any photo that, in its sole discretion, violates these terms, without prior notice.
7.4 Data Storage and Privacy
Photos uploaded to the Photo Feature are subject to the following data handling practices:
a. Storage: Photos are stored securely using encryption in compliance with industry standards.
b. Access Limitation: Photos are only visible to the client who uploaded them and their matched personal trainer.
c. No Export Function: The Photo Feature does not allow photos to be shared with other users or exported from the app.
d. Deletion and Ownership:
Photos are permanently deleted only when a client deletes their account or when either party manually deletes specific photos through the app interface
If a PT and client unmatch, all photos remain accessible to the client but will no longer be visible to the PT
If a PT deletes their account, all client photos (regardless of who uploaded them) remain intact and accessible to the respective clients
All progress photos are considered to be owned by the client, regardless of which party uploaded them
e. Client Account Deletion: If a client deletes their account, all their progress photos will be permanently deleted from the system
f. No Commercial Use: PT Organizer will not use user photos for advertising, marketing, or other commercial purposes.
7.5 User Controls
The Photo Feature provides users with the following controls:
a. Opt-In Requirement: Use of the Photo Feature requires explicit opt-in by both parties.
b. Withdrawal of Consent: Users may withdraw consent and disable the Photo Feature at any time through account settings.
c. Deletion Rights: Either the client or trainer may delete any photo at any time.
d. Reporting: Users may report potentially violating content through the app interface.
7.6 Enforcement and Penalties
PT Organizer may take the following actions to enforce these terms:
a. Account Restriction: Users who violate these terms may have their access to the Photo Feature restricted or revoked.
b. Account Suspension: Severe or repeated violations may result in temporary or permanent suspension of the user’s PT Organizer account.
c. Legal Reporting: PT Organizer reserves the right to report illegal content to relevant authorities.
7.7 Liability and Indemnification
a. User Responsibility: Users are solely responsible for all content they upload to the Photo Feature.
b. No Liability: PT Organizer shall not be liable for any damages arising from misuse of the Photo Feature or from content uploaded by users.
c. Indemnification: Users agree to indemnify and hold harmless PT Organizer, its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from their use of the Photo Feature in violation of these terms.
7.8 Modifications to Terms
PT Organizer may modify these Photo Feature terms at any time by posting updated terms in the app or on our website. Continued use of the Photo Feature after such changes constitutes acceptance of the modified terms.
By using the Progress Photo Feature, you acknowledge that you have read, understood, and agree to be bound by these terms.
7.9 Prohibited Activities
Users may not:
• Share account credentials
• Upload harmful content or malware
• Violate others’ intellectual property rights
• Use the App for illegal activities
• Harass or harm other users
• Attempt to access unauthorized areas of the App
• Create multiple accounts
8 | Liability and Disclaimers
8.1 Health and Safety
Users participate in physical activities at their own risk. PT Organizer is not responsible for:
• Injuries during training
• Quality of training services
• Disputes between PTs and Clients (note: for payment disputes, clients may use Stripe’s dispute process and chargebacks, which can be appealed by PTs through the app but are ultimately handled by Stripe and the client’s bank)
• Loss of data or content
8.2 Service Availability
• App provided “as is” without warranties
• No guarantee of uninterrupted service
• PT Organizer may modify or discontinue features
9 | Termination
• Users may terminate their account per deactivation process
• PT Organizer may terminate accounts for Terms violations
• Unused sessions must be resolved before termination
• Termination does not affect PayPTPro LLC’s data rights
10 | Changes to Terms
PT Organizer reserves the right to modify these Terms at any time. Users will be notified of significant changes. Continued use of the App constitutes acceptance of modified Terms.

12 Governing Law
These Terms are governed by the laws of the State of Wyoming. Any disputes shall be subject to the exclusive jurisdiction of the courts of Wyoming, United States.
